I was involved in a hit and run truck accident. How do I go about recovering these damages?
Question: During a terrible rain storm, my family and I were traveling down the Interstate, trying to get to our motel for the night. Just as we were trying to take the exit to our motel, a truck driver came barreling across the freeway from the other direction and hit us head on. My youngest child in the back seat was seriously injured and now has serious speech problems. The guy in the moving van just kept right on driving after he hit us. Who should I contact first? I did see the moving company’s logo on the side of the van.
Response: Hopefully, you have obtained all of the necessary medical care required by each member of your family. If so, you need to immediately seek out a personally injury attorney who specializes in major trucking accidents and is familiar with pursing brain injury claims.
Since the van driver is guilty of a hit-and-run accident, he or she may face criminal charges in addition to being ticketed for the accident. It’s always possible that alcohol or drugs were involved when a driver crosses a freeway median or veers into oncoming traffic. That issue must also be researched.
Truck laws can vary a bit from state to state so you’ll need your attorney to carefully research those for you. However, fairly standard penalties apply to those who are hit-and-run drivers.
